This Politikën e Abonimit is based on Ligji për Marrëdhëniet e Detyrimeve, Ligji për Mbrojtjen e Konsumatorëve, Ligji për Mbrojtjen e të Dhënave Personale, Rregullorja e Përgjithshme për Mbrojtjen e të Dhënave (GDPR) ku është e aplikueshme, dhe rregulloret e tjera pozitive që janë në fuqi në territorin e Republikën e Maqedonisë së Veriut.

1. Description of planet e abonimit

Our internet platform www.hommex.al offers planet e abonimit that provide users with additional features and benefits when using platforma. The specific features included in each plan are listed on our platform's plans page and may vary between different plans.

VORTEK INOVATIONS reserves the right to modify, add, or remove features included in the planet e abonimit.

Planet e abonimit may be available in different cikli i faturimits (for example, monthly or yearly). Each cikli i faturimit offers the same functionality within the same plan category, but at a different price.

2. Periudha e provës

Certain planet e abonimit may include a free periudha e provës. The duration of the periudha e provës is specific to each plan and is clearly indicated when selecting the plan on platforma. During the periudha e provës, the user has full access to the features of the selected plan.

Upon completion of the periudha e provës, the subscription automatically activates and the amount of the selected plan is charged, unless the user canceled the subscription before the periudha e provës expired. The user will be notified of the upcoming periudha e provës expiration via email.

Each user is entitled to one free periudha e provës per plan category. If the user has already used the periudha e provës for a certain category, upon re-subscribing to a plan of the same category, billing begins immediately, without a periudha e provës.

To activate the periudha e provës, the user must have a valid karta e pagesës registered on their profili i përdoruesit. The card will not be charged during the periudha e provës but will be used for billing after its completion, if the subscription is not canceled.

3. Prices and payment methods

Subscription plan prices are displayed in the currency defined for each plan and are listed on our platform's plans page. All displayed prices include value-added tax (VAT). Shoqëria tregtare dhe e shërbimeve VORTEK INOVATIONS D.O.O. Skopje me NUI MK4057024570335 and EMBS 7757832 është paguese e TVSH-së.

Payment for planet e abonimit is made via karta e pagesës (VISA or MasterCard). All transactions are processed through the payment processing system of Halk Bank AD Skopje, which is certified by VISA and MasterCard for transaction processing. The payment uses HTTPS security protocol and Secure Socket Layer (SSL) technology to protect your data. We have no access to your karta e pagesës data (card number, security code, or your account balance).

VORTEK INOVATIONS reserves the right to change plani i abonimit prices. Price changes take effect at least 30 days after their publication on platforma. The new price will apply from the beginning of the next cikli i faturimit. If the user does not agree with the new price, they have the right to cancel the subscription before the change takes effect.

4. Automatic renewal and cikli i faturimit

All planet e abonimit renew automatically at the end of each cikli i faturimit, unless the user cancels the subscription before the current period expires. Automatic renewal means charging the subscription amount from the karta e pagesës saved on the user's profile.

By subscribing to any plan, the user explicitly agrees to automatic renewal and periodic billing until the moment they cancel the subscription.

5. Subscription cancellation

The user has the right to cancel the subscription at any time, free of charge and without obligation to provide a reason. There are two cancellation methods:

  • Cancellation at the end of the current period — The subscription remains active until the end of the current paid period. After that period expires, the subscription will not renew and the user will lose the benefits of the selected plan. The user retains the ability to reactivate the subscription before the current period expires.
  • Immediate cancellation — The subscription is deactivated immediately and the user loses all benefits of the selected plan from the moment of cancellation.

Cancellation can be made through the user's profile on the payments page or by sending a request to our mbështetja e klientëve team at email: hello@hommex.co.

The user has the right to cancel the subscription during the periudha e provës as well. In that case, no charge will be made and the user will retain the plan benefits until the periudha e provës expires.

6. Grace period for failed payments

If the charge cannot be made during the automatic renewal of the subscription (for example, due to insufficient funds, expired card, or other reasons), the subscription enters a "grace period" status. The duration of the grace period is defined by the terms of the selected plan and is indicated when creating the subscription. During the grace period, the system will automatically attempt to retry the charge.

The user has the option to manually retry the payment through the payments page on their profili i përdoruesit or to update the karta e pagesës details.

If the charge is not successfully made within the grace period, the subscription will automatically be deactivated and will transition to an "expired" status. The user will lose all plan benefits.

7. Plan and cikli i faturimit changes

The user has the right to change the cikli i faturimit (for example, from monthly to yearly or vice versa) during the subscription period. The cikli i faturimit change can be made through the user's profile on the payments page.

When changing the cikli i faturimit, the current subscription period remains unchanged. The new cycle and new price will take effect from the beginning of the next billing period.

8. Subscription reactivation

If the user canceled the subscription with the option of "cancellation at the end of the current period," they have the ability to reactivate the subscription at any time before the current paid period expires. With reactivation, automatic renewal is re-enabled and the subscription will continue uninterrupted after the current period expires.

If the subscription has already expired or was immediately canceled, the user can subscribe to a new plan through the plans page on platforma.

9. Refund policy

Given that planet e abonimit provide immediate access to digital services and features, and in accordance with Ligji për Mbrojtjen e Konsumatorëve, the user waives the right of withdrawal (right to refund) after subscription activation, unless otherwise provided by applicable legislation.

If the user cancels the subscription before the end of the current paid period, they retain the plan benefits until the end of that period, but are not entitled to a partial or full refund for the remaining time.

In exceptional cases, VORTEK INOVATIONS may at its discretion approve a partial or full refund, particularly in cases of technical problems or billing errors attributable to platforma. For refund requests, the user can contact our mbështetja e klientëve team at email: hello@hommex.co.

If the charge was made after the periudha e provës ended due to the user's failure to cancel the subscription on time, the user has the right to request a refund within 14 (fourteen) days from the date of the charge, provided they have not used the plan features after the periudha e provës ended.

10. Personal data processing related to the subscription

When creating and managing the subscription, VORTEK INOVATIONS processes the following categories of personal data:

  • Identification data — first name, last name, and email address from the profili i përdoruesit, which are necessary for identifying the subscriber and communicating regarding the subscription.
  • Transaction data — date and amount of charge, transaction status and transaction identifier, necessary for recording payments and fulfilling tax and accounting obligations.
  • Subscription data — selected plan, subscription status, start and end date of the current period, periudha e provës information, and cancellation reason (if provided), necessary for service management.
  • Të dhënat për kartat e pagesës të ruajtura — token për identifikimin e kartës pranë Halk bankës, marka (VISA/MasterCard), katër shifrat e fundit, data e skadimit dhe treguesi i kartës parazgjedhur. Këto të dhëna ruhen me pëlqimin tuaj dhe janë të nevojshme për ekzekutimin e tarifimeve automatike të abonimit.
  • Adresa e faturimit — emri dhe mbiemri, adresa e e-mail, emri i personit juridik dhe numri tatimor (opsionale), si dhe adresa e plotë (rruga, qyteti, rajoni, kodi postar, shteti). Këto të dhëna përdoren për lëshimin e faturave në përputhje me legjislacionin tatimor.

Ne nuk mbledhim dhe nuk ruajmë të dhënat e plota të kartave të pagesës (numrin e plotë të kartës, kodin e sigurisë CVV/CVC, dhe as gjendjen e llogarisë). Të gjitha të dhënat e ndjeshme të kartave përpunohen dhe ruhen ekskluzivisht nga Halk banka AD Skopje, në përputhje me standardet PCI DSS (Payment Card Industry Data Security Standard).

Nëse zgjidhni të ruani kartën tuaj të pagesës për tarifimet e ardhshme automatike të abonimit, në serverët tanë ruajmë vetëm grupin e kufizuar të të dhënave të listuara në pikën 3.5 të Politikës sonë të Privatësisë (token i kartës, marka, katër shifrat e fundit dhe data e skadimit). Këto të dhëna nuk janë të mjaftueshme për përdorim të paligjshëm të kartës jashtë sistemit tonë.

Mund të ruani karta të shumta pagese në llogarinë tuaj dhe të zgjidhni një si parazgjedhur (default) për tarifimet automatike të abonimit. Menaxhimi i kartave të ruajtura (shtimi, fshirja, ndryshimi i parazgjedhurës) kryhet nëpërmjet faqes së pagesave të llogarisë suaj.

The legal basis for processing personal data related to the subscription is the performance of the subscription agreement between the user and VORTEK INOVATIONS, as well as the fulfillment of legal obligations related to tax and financial record-keeping.

Personal data related to the subscription is retained for the duration of the subscription and an additional period required for fulfilling legal obligations for maintaining financial documentation, in accordance with the applicable legislation of Republikën e Maqedonisë së Veriut.

11. User rights

Regarding the processing of personal data related to the subscription, the user has the following rights, in accordance with Ligji për Mbrojtjen e të Dhënave Personale and Rregullorja e Përgjithshme për Mbrojtjen e të Dhënave (GDPR):

  • Right to information and access — The user has the right to be informed about the processing of their personal data and to request access to it.
  • Right to rectification — The user has the right to request correction of inaccurate personal data.
  • Right to erasure — The user has the right to request deletion of personal data when it is no longer necessary for the purpose for which it was collected, unless there is a legal obligation for its retention.
  • Right to restriction of processing — The user has the right to request restriction of the processing of personal data in certain circumstances provided by law.
  • Right to data portability — The user has the right to receive the personal data they have provided in a structured, commonly used, and machine-readable format.
  • Right to object — The user has the right to object to the processing of personal data.
  • Right to lodge a complaint with a supervisory authority — The user has the right to lodge a complaint with the Personal Data Protection Agency of Republikën e Maqedonisë së Veriut if they believe that the processing of their personal data violates applicable regulations.

12. Liability

VORTEK INOVATIONS will make reasonable efforts to ensure uninterrupted availability of the plani i abonimit features. However, we do not guarantee that the service will be available without interruptions, errors, or technical problems.

VORTEK INOVATIONS is not liable for damages caused by failed payments due to reasons beyond platforma's control (for example, banking system problems, insufficient funds on the card, or an expired card).

In the case of a prolonged service interruption caused by platforma, VORTEK INOVATIONS may at its discretion extend the current subscription period for the duration of the interruption.

13. Age restriction

The subscription is available exclusively to adults (over 18 years of age). By activating the subscription, the user confirms that they are an adult and have the right to enter into agreements and make payments in accordance with applicable legislation.

14. Changes to the Politikën e Abonimit

VORTEK INOVATIONS reserves the right to make changes to this Politikën e Abonimit at any time. Continued use of the planet e abonimit after the publication of changes constitutes acceptance of the amended Policy.

Changes take effect upon publication on the internet platform, unless otherwise indicated.

16. Ligji i aplikueshëm dhe zgjidhja e mosmarrëveshjeve

This Politikën e Abonimit is interpreted and applied in accordance with the laws of Republikën e Maqedonisë së Veriut. For all disputes arising from or related to this Policy, the competent court is in Skopje, Republika e Maqedonisë së Veriut.

Before initiating court proceedings, the parties will attempt to resolve the dispute through mutual agreement. The user has the right to file a complaint with VORTEK INOVATIONS, which will be reviewed within 15 (fifteen) business days from receipt of the complaint.
